1. Introduction & Acceptance

Welcome to Afandeena (the “Site”), operated by Betifly LTD (“we,” “us,” or “our”).

These Terms and Conditions (“Terms”) govern your use of our Site and the services and products offered on it. By accessing the Site, creating an account, or purchasing our products or services, you agree to be bound by these Terms.

If you do not agree with all of these Terms, you are prohibited from using the Site and must discontinue use immediately.

2. Services Provided

We offer two primary categories of services:

  1. Digital Products: We provide access to a repository of third-party digital products, primarily WordPress plugins and themes (the “Plugins”). These items are redistributed by us under the GNU General Public License (GPL).
  2. Marketing Services: We provide professional digital marketing services (“Marketing Services”), which may include but are not limited to SEO, content creation, social media management, and digital strategy.

3. Digital Products (GPL Plugins)

a) Licensing and Nature of Products

All WordPress plugins and themes offered on this Site are developed by third-party developers and redistributed by Afandeena in full compliance with the GNU General Public License (GPL).

You are not purchasing the intellectual property (IP) of the plugins. You are paying for a membership that grants you access to our repository for downloads and updates.

b) Trademarks & Ownership

Any and all trademarks, such as “WordPress,” “WooCommerce,” “Elementor,” etc., are the property of their respective owners. Afandeena is not endorsed by, affiliated with, or associated with any of these third-party developers.

c) Support

The GPL plugins we provide do not include official support from the original developers. Your membership fee pays for access to the files, not for technical support. We may offer basic support for installation or access to our Site, but we are not obligated to provide technical support for the plugins themselves.

4. Marketing Services

a) Scope of Work

Our Marketing Services are governed by a separate Scope of Work (SOW) or proposal that will be provided to you before engagement. This SOW will detail the specific services to be rendered, timelines, and fees.

b) Client Responsibilities

To ensure the success of our Marketing Services, you agree to provide timely access to all necessary resources, including but not limited to: website logins, brand assets, product information, and necessary approvals.

c) No Guarantees

We will use commercially reasonable efforts to deliver the Marketing Services. However, we make no guarantee of specific results. You acknowledge that marketing and search engine rankings are subject to numerous factors outside of our control (e.g., search engine algorithm changes, market competition), and we cannot guarantee any particular outcome, ranking, or increase in traffic or revenue.

5. Accounts and Membership

To access our Digital Products, you must register for an account and purchase a membership subscription.

  • Account Security: You are responsible for maintaining the confidentiality of your account password. You agree to accept responsibility for all activities that occur under your account.
  • Account Sharing: Your membership is non-transferable. You are not permitted to share your account credentials or allow others to use your account. We reserve the right to terminate any account found to be in violation of this policy without a refund.

6. Payments, Subscriptions, and Refunds

a) Subscriptions

Our Digital Products are offered via a membership subscription (e.g., monthly, annually).

  • Automatic Renewal: Your subscription will automatically renew at the end of each billing cycle unless you cancel it.
  • Cancellation: You may cancel your subscription at any time from your account dashboard. Your access to the digital products will continue until the end of your current billing period.

b) Payment

All payments are processed through third-party payment gateways (e.g., Stripe, PayPal). We do not store or collect your payment card details.

c) Refund Policy

  • For Digital Products (Plugins): Due to the digital nature of our products and their immediate accessibility upon purchase, we generally do not offer refunds. All sales are final. We may, at our sole discretion, offer a refund within 7 days of the original purchase if you can demonstrate that a product is broken or non-functional and we are unable to provide a working version. We do not issue refunds for subscription renewals.
  • For Marketing Services: Refunds for Marketing Services are governed by the terms specified in your individual SOW or service agreement.

7. Prohibited Conduct

You agree not to use the Site to:

  • Share, re-sell, or otherwise distribute your account credentials or membership access.
  • Use any product downloaded from our Site for any illegal or unauthorized purpose.
  • Attempt to gain unauthorized access to our Site, servers, or any user accounts.
  • Infringe upon our intellectual property (the Afandeena brand, logo, and website content, which are the property of Betifly LTD).

8. Limitation of Liability

All products and services are provided “AS IS” and “AS AVAILABLE” without any warranty or condition, express, implied, or statutory.

Betifly LTD, its directors, employees, and agents will not be liable for any direct, indirect, incidental, special, or consequential damages (including, but not limited to, loss of data, loss of profits, or website downtime) arising from the use of, or inability to use, the products or services offered on this Site.

You are solely responsible for backing up your website and data before installing or using any plugin downloaded from our Site.

9. Indemnification

You agree to indemnify and hold harmless Betifly LTD and its affiliates, officers, agents, and employees from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

10. Termination

We may, in our sole discretion, suspend or terminate your account and access to the Services, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of United Kingdom, without regard to its conflict of law provisions.

12. Changes to These Terms

We reserve the right to modify or replace these Terms at any time. We will notify you of any changes by posting the new Terms and Conditions on this page and updating the “Effective Date.”
